§ 1 General

These General Terms and Conditions of Business (as amended) shall apply to business relationships of any kind between Jens Ritter Instruments and the customer. Customers may be businesses or consumers. A consumer shall mean any natural person who concludes a legal transaction for purposes that can be primarily attributed neither to a trade nor a profession (§ 13 of the German Civil Code). A business shall mean a natural or legal person or a partnership with legal capacity which, in concluding a legal transaction, is acting in the exercise of its trade or profession (§ 14 of the German Civil Code). The currency used for all rates and for all transactions is the Euro (currency code: EUR).

§ 2 Payments

An order is considered confirmed after a deposit payment of 50% of the total retail price has been received by Jens Ritter Instruments.

Towards the end of the production process, another interim payment is due. An amount equal to 25% of the total sales price will be invoiced before the instrument’s finish is applied.

The order will be shipped once Jens Ritter Instruments has received full payment for the complete order. If, for any reason, a payment is not made within 6 months of sending the final invoice, the ordered goods automatically become the property of Jens Ritter Instruments.

Down payments are non-refundable for businesses. Down payments are non-refundable for consumers after production of the order has started.

Jens Ritter Instruments reserves the right to refuse or cancel any order, whether or not the order has already been confirmed. Any down payments made will be reimbursed by Jens Ritter Instruments.

§ 3 Delivery Times

The expected delivery date mentioned on order forms or in any other forms of communication can be changed at any time by Jens Ritter Instruments without prior notice.

§ 4 Shipping

For Dealers
Shipping costs are not included in the dealer prices. All shipping costs must be paid by the dealer.

For Consumers and Businesses
Retail prices include shipping to the address provided by the consumer or business. If no shipping address is provided by the customer, Jens Ritter Instruments will use the invoice address.

Damage During Shipping
In case of damage during shipping, the recipient must contact and inform the transportation company and Jens Ritter Instruments within 24 hours (1 working day) with a detailed description, including pictures, of the damage to the product and/or packaging. Example for an instrument: detailed documentation of the instrument, the case/gigbag, and the packaging.

Damage reports received later than 24 hours after receiving the instrument(s) are not covered by our insurance, and the recipient will have to bear the cost of repair.

Customs and VAT
Please note that all orders are shipped from Germany. Any import duties and taxes payable will be charged once the parcel has reached the destination country. These charges must be paid by the recipient of the parcel. Jens Ritter Instruments is not in a position to inform the customer of these fees, and the customer is responsible for the payment of VAT and customs. If you have any questions related to customs charges, please contact your local customs office.

§ 5 Return Policy

Goods (except for custom-made instruments) can be returned within 14 days of delivery. The amount paid will be refunded minus a 15% handling fee. It is not possible to return custom-made instruments.

If you have paid for your order using a different currency than EUR, you will be refunded using the exchange rate of the date of purchase. Jens Ritter Instruments shall not be held responsible or accountable in case of unfavorable exchange rate developments.

Jens Ritter Instruments is not able to refund customs duties and taxes on orders shipped outside the EU. However, you may be able to recover these by contacting your local customs bureau directly

§ 6 Warranty

Your new Jens Ritter instrument is warranted to be free from defects in materials and workmanship for five years from the delivery date. This warranty is made only to the original retail purchaser, subject to the limitations contained herein, and is not transferable.

If at any time your instrument malfunctions as a result of faulty materials or workmanship, Jens Ritter Instruments will repair the defect(s) or replace the instrument, as it deems appropriate in its sole discretion. Jens Ritter Instruments reserves the right to use comparable materials readily available at the time of repair in the event that original materials are no longer available. If replacement of your instrument is deemed appropriate by our staff, Jens Ritter Instruments will replace the instrument with one of the same or most similar style of a value not in excess of the original purchase price of your instrument.

This warranty does not cover:

• Any instrument that has been altered or modified in any way beyond the original condition as delivered to the customer.
• Any instrument that has been damaged due to abuse, misuse, negligence, accident, or improper operation.
• The subjective issue of tonal characteristics.
• Any instrument that has been subjected to extremes of humidity or temperature.
• Normal wear and tear (e.g., worn frets, worn machine heads, worn plating, string replacement, scratched pickguards, or damages to or discoloration of the instrument's finish for any reason).
• Any instrument upon which unauthorized repair or service has been performed by any third party other than Jens Ritter Instruments.
• Cracking, discoloration or damage of any sort to the finish or plating for any reason.

§ 7 Wood

Wood owes its inherent beauty to variations in color, grain, and texture; therefore, these variations are not considered defects.

Due to the natural color and grain variances of wood, the final finish color, texture, and grain may vary from one instrument to another, even though they are finished at the same time. Exposure to light and the aging process will cause changes in surface color of natural wood products. Light finishes on wood products do not mask the natural characteristics of wood.

Jens Ritter Instruments does not guarantee the exact matching of grain, pattern, or color. Instruments will not be replaced because of these conditions:

• Natural variations in wood grain, veneer figure, character marks, texture or color
• Prominent evidence of natural characteristics of wood when light finishes are selected
• Variations in finish from one instrument to another
• Changes in finish surfaces due to exposure to light and/or the natural aging process

Color perceptions vary from individual to individual, as almost everyone sees color differently. We have done our best to display, as accurately as possible, the colors of the instruments shown on this website. However, for the reasons mentioned above, we cannot guarantee that the product you receive will be an exact match to what is displayed on our product description page.

§ 8 Place of fulfilment and place of jurisdiction

The law of the Federal Republic of Germany shall apply with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.

The place of fulfilment for all services and products arising from business transactions with Jens Ritter Instruments shall be Deidesheim, insofar as the customer is a merchant, a legal person governed by public law, or a special fund under public law.

If the customer is a merchant, a legal person governed by public law, or a special fund under public law, Bad Duerkheim shall be the exclusive place of jurisdiction for any disputes arising directly or indirectly from the contractual relationship with the customer or from these General Terms and Conditions of Business. ^

§ 9 Closing Provision

If any of these provisions cannot be applied for whatever reason, this shall not affect the validity of the remaining provisions.

§ 1 Allgemeines

Diese Allgemeinen Geschäftsbedingungen (in der jeweils gültigen Fassung) gelten für sämtliche Geschäftsbeziehungen zwischen Jens Ritter Instruments und dem Kunden. Kunden können Unternehmer oder Verbraucher sein.

Ein Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können (§ 13 BGB).

Ein Unternehmer ist eine natürliche oder juristische Person oder eine rechtsfähige Personengesellschaft, die bei Abschluss eines Rechtsgeschäfts in Ausübung ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handelt (§ 14 BGB).

Die für alle Preise und Transaktionen maßgebliche Währung ist der Euro (Währungscode: EUR)

§ 2 Zahlungen

Eine Bestellung gilt als bestätigt, sobald eine Anzahlung in Höhe von 50 % des Gesamtverkaufspreises bei Jens Ritter Instruments eingegangen ist.

Gegen Ende des Produktionsprozesses ist eine weitere Zwischenzahlung fällig. Ein Betrag in Höhe von 25 % des Gesamtverkaufspreises wird in Rechnung gestellt, bevor die Lackierung des Instruments erfolgt.

Der Versand der Bestellung erfolgt erst, wenn Jens Ritter Instruments die vollständige Zahlung für die gesamte Bestellung erhalten hat. Erfolgt die Zahlung aus irgendeinem Grund nicht innerhalb von 6 Monaten nach Zusendung der Schlussrechnung, gehen die bestellten Waren automatisch in das Eigentum von Jens Ritter Instruments über.

Anzahlungen sind für Unternehmer nicht erstattungsfähig. Für Verbraucher sind Anzahlungen nach Beginn der Produktion der Bestellung nicht erstattungsfähig.

Jens Ritter Instruments behält sich das Recht vor, Bestellungen abzulehnen oder zu stornieren, unabhängig davon, ob sie bereits bestätigt wurden oder nicht. Bereits geleistete Anzahlungen werden in diesem Fall zurückerstattet.

§ 3 Lieferzeiten

Das auf Bestellformularen oder in sonstiger Kommunikation genannte voraussichtliche Lieferdatum kann von Jens Ritter Instruments jederzeit ohne vorherige Ankündigung geändert werden.

§ 4 Versand

Für Händler
Die Versandkosten sind in den Händlerpreisen nicht enthalten. Alle Versandkosten sind vom Händler zu tragen.

Für Verbraucher und Unternehmen
Die Endverkaufspreise beinhalten den Versand an die vom Verbraucher oder Unternehmen angegebene Adresse. Wird keine Versandadresse angegeben, erfolgt die Lieferung an die Rechnungsadresse.

Transportschäden
Im Falle von Transportschäden muss der Empfänger innerhalb von 24 Stunden (1 Werktag) das Transportunternehmen und Jens Ritter Instruments informieren und eine detaillierte Schadensbeschreibung einschließlich Fotos übermitteln.
Beispiel bei einem Instrument: detaillierte Dokumentation des Instruments, des Koffers/Gigbags sowie der Verpackung.

Schadensmeldungen, die später als 24 Stunden nach Erhalt der Ware eingehen, sind nicht durch unsere Versicherung abgedeckt. In diesem Fall trägt der Empfänger die Kosten der Reparatur.

Zoll und Mehrwertsteuer
Bitte beachten Sie, dass alle Bestellungen aus Deutschland versendet werden. Eventuell anfallende Einfuhrabgaben und Steuern werden erhoben, sobald das Paket das Zielland erreicht hat. Diese Gebühren sind vom Empfänger zu tragen. Jens Ritter Instruments ist nicht in der Lage, den Kunden über die Höhe dieser Gebühren zu informieren. Der Kunde ist für die Zahlung von Zoll und Mehrwertsteuer verantwortlich. Bei Fragen zu Zollgebühren wenden Sie sich bitte an Ihr örtliches Zollamt.

§ 5 Rückgaberecht

Waren (außer individuell angefertigten Instrumenten) können innerhalb von 14 Tagen nach Lieferung zurückgegeben werden. Der gezahlte Betrag wird abzüglich einer Bearbeitungsgebühr von 15 % erstattet. Eine Rückgabe von individuell angefertigten Instrumenten ist ausgeschlossen.

Wenn die Zahlung in einer anderen Währung als EUR erfolgt ist, erfolgt die Rückerstattung zum Wechselkurs des Kaufdatums. Jens Ritter Instruments übernimmt keine Haftung für ungünstige Wechselkursentwicklungen.

Eine Erstattung von Zollabgaben und Steuern für außerhalb der EU versandte Bestellungen ist nicht möglich. Eine Rückforderung dieser Beträge kann gegebenenfalls direkt beim zuständigen Zollamt erfolgen.

§ 6 Garantie

Ihr neues Jens Ritter Instrument ist für einen Zeitraum von fünf Jahren ab Lieferdatum gegen Material- und Verarbeitungsfehler garantiert. Diese Garantie gilt ausschließlich für den ursprünglichen Käufer und ist nicht übertragbar.

Sollte Ihr Instrument aufgrund von Material- oder Verarbeitungsfehlern einen Defekt aufweisen, wird Jens Ritter Instruments den Mangel nach eigenem Ermessen durch Reparatur oder Austausch beheben. Jens Ritter Instruments behält sich das Recht vor, bei Reparaturen vergleichbare, aktuell verfügbare Materialien zu verwenden, falls Originalmaterialien nicht mehr erhältlich sind.

Wird ein Austausch für angemessen erachtet, ersetzt Jens Ritter Instruments das Instrument durch ein gleiches oder ein möglichst ähnliches Modell, dessen Wert den ursprünglichen Kaufpreis nicht übersteigt.

Von der Garantie ausgeschlossen sind:

• Jegliche Veränderung oder Modifikation des Instruments über den ursprünglichen Auslieferungszustand hinaus.

• Schäden durch unsachgemäße Behandlung, Missbrauch, Fahrlässigkeit, Unfall oder unsachgemäßen Gebrauch.

• Subjektive Einschätzungen der klanglichen Eigenschaften.

• Schäden durch extreme Feuchtigkeit oder Temperaturen.

• Normale Gebrauchsspuren (z. B. abgenutzte Bünde, Mechaniken, Beschichtungen, Saitenwechsel, Kratzer oder Verfärbungen der Lackierung).

• Schäden durch nicht autorisierte Reparaturen oder Serviceleistungen Dritter.

• Risse, Verfärbungen oder sonstige Schäden an Lackierungen oder Beschichtungen.

§ 7 Holz

Die Schönheit von Holz beruht auf natürlichen Farb-, Maserungs- und Strukturunterschieden. Diese Unterschiede stellen keinen Mangel dar.

Aufgrund dieser natürlichen Variationen können sich Farbe, Maserung und Struktur selbst bei gleichzeitig gefertigten Instrumenten unterscheiden. Zudem verändern Lichteinfluss und Alterungsprozesse die Oberflächenfarbe.

Helle Lackierungen verdecken die natürlichen Eigenschaften des Holzes nicht. Jens Ritter Instruments garantiert daher keine exakte Übereinstimmung von Maserung, Muster oder Farbe.

Instrumente werden nicht ersetzt aufgrund von:

• Natürlichen Unterschieden in Maserung, Furnierbild, Struktur oder Farbe.

• Deutlicher Ausprägung natürlicher Holzmerkmale bei hellen Lackierungen.

• Abweichungen der Lackierung zwischen einzelnen Instrumenten.

• Veränderungen durch Lichteinwirkung oder natürliche Alterung.

Da Farbwahrnehmungen individuell unterschiedlich sind, können die auf der Website dargestellten Farben vom tatsächlich gelieferten Instrument abweichen.

§ 8 Erfüllungsort und Gerichtsstand

Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts (CISG).

Erfüllungsort für alle Leistungen und Produkte aus Geschäftsbeziehungen mit Jens Ritter Instruments ist Deidesheim, sofern der Kunde Kaufmann, eine juristische Person des öffentlichen Rechts oder ein öffentlich-rechtliches Sondervermögen ist.

Ist der Kunde Kaufmann, eine juristische Person des öffentlichen Rechts oder ein öffentlich-rechtliches Sondervermögen, so ist ausschließlicher Gerichtsstand für alle Streitigkeiten aus oder im Zusammenhang mit diesen AGB oder dem Vertragsverhältnis Bad Dürkheim.

§ 9 Schlussbestimmung

Sollte eine Bestimmung dieser AGB unwirksam sein oder werden, so bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.
